Contract for the supply of products and services
No contract for the supply of products or goods will be deemed to exist between you and Best Crystal Nail Files unless, and until, an email is sent by Best Crystal Nail Files to you confirming that your order has been accepted and payment has been successfully made.
This confirmation e-mail amounts to an acceptance by Best Crystal Nail Files of your offer to buy goods or services from bestcrystalnailfiles.co.uk and this acceptance is effective regardless of whether or not you receive the email.
Best Crystal Nail Files are free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods or services, any description applied to the goods or services, the availability of the goods or services, or the order itself.
All goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, we will inform you as soon as possible by email or by telephone, and refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods. We will not charge you for goods that we cannot supply. However we will not be responsible for any damage or losses that you may suffer if we fail to supply the goods. We have attempted to display the goods on the site as accurately and fairly as possible but are subject to the available reproduction techniques.
The description, specification and price of the goods you order will be as shown on this Site at the time you place your order. Our policy is to improve our products continually, and so we reserve the right to make minor technical changes to the specification of the goods without affecting their function, quality or price.
Every effort will be made to ensure that prices shown on this Site are accurate at the time you place your order. If an error is found prior to despatch of the goods, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, we will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.
Payment
Payment for the goods and delivery charges are made online. We use RBS Worldpay for processing payments on our Site. We accept payment by Visa/MasterCard/Solo/Maestro/AmericanExpress or any other credit card identified on our Site. Credit and charge card payments are subject to validation and authorisation by the card issuer and we will not be liable for any non-delivery or delay if a card issuer refuses to authorise payment. Transmission of your debit or credit card number and other details in relation to payment will be at your own risk. We cannot accept responsibility or liability for failures in transmission of information deletion, non-delivery or failure to store any communications by you.
Delivery
The goods you order will be delivered to the address you give when you place your order. You may select a different billing and delivery address.
If delivery cannot be made to your address, we will inform you as soon as possible, and refund or re-credit you for any sum that has been paid by you or debited from your credit card for delivery.
Every effort will be made to deliver the goods as soon as possible after your order has been accepted, and if we are unable to deliver the goods within 30 days of your order, we will inform you as soon as possible and you will be entitled to cancel the order and obtain a refund or re-credit for any sum that has been paid by you or debited from your credit card for the goods. Best Crystal Nail Files will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery.
You will become the owner of the goods you have ordered and responsible for any loss or damage to them once they have been delivered to you.
Shipping addresses
We reserve the right to ship all items to the billing address on the credit card if we suspect that a credit card fraud may be taking place. We will not ship to an address which is in a different country to that of the billing address. Any fraudulent activity will be reported to the police. We will always prosecute thieves without exception.
Customer obligations
By placing your order you confirm that you agree to use your correct name, address and date of birth and to supply any other details reasonably requested.
Prices
The prices displayed on our site are correct at the time of display. However we reserve the right to alter prices from time to time without notice. When we have accepted an order we will not change the price that applies to that order. We make every effort to maintain prices but these may be subject to variations caused by factors beyond our control. The price of the goods and delivery charges are exclusive of VAT, since we are not registered for VAT. Your right of cancellation & refund
If you are a consumer, you have the right to cancel the contract at any time up to the end of seven working days after you receive the goods. A working day is any day other than weekends and bank or other public holidays in the United Kingdom. Refunds will be issued on all returned goods following a complete inspection of the item in question and providing that the goods are returned in the same condition that you received them, within 7 Days of receipt. Under no circumstances will we accept returned goods for refunds later than 7 days after they have been signed for.
To exercise your right of cancellation, you must give written notice to us by hand or post or email, at the address or email address shown below, giving details of the goods ordered and (where appropriate) their delivery.
If you exercise your right of cancellation after the goods have been delivered to you, you must return the goods to us at your own cost, in unused and otherwise re-saleable condition. You must take reasonable care to ensure the goods are not damaged whilst in your possession or in transit. Once you have notified us that you are cancelling the order, we will refund or re-credit you within 14 days for any sum that has been paid by you or debited from your credit card for the goods. All funds paid will be returned either by cheque or electronic payment, excluding return postage and packing. If you do not return the goods as required, we may charge you for the direct costs of recovering the goods.
Warranty claims can be made for manufacturers faults only. No responsibility will be taken for damage caused to goods through careless or rough handling or misuse or abuse of any kind.
Undelivered item claims. Any fraudulent claims for unreceived items will be treated seriously and all relevant information will be passed to the police. Once a signature has been received from somebody at the delivery address, or billing address, specified by the buyer at the time of placing the order, as far as we are concerned, the item has been delivered Damaged goods during delivery. In the event that goods get damaged during transport, you must inform us immediately after goods are delivered. A replacement item will be shipped to you once the damaged item is returned to us.
Intellectual Property rights
This Site and its content are protected by intellectual property rights, including but not limited to copyright and trade marks.
Except as expressly authorised by us or relevant third parties, you may not copy, download, adapt, alter, modify, rent, lease, loan, sell, distribute, communicate or make available to the public or create derivative works of any content of the Site, in whole or in part.
You may not create a link from any other website to any part of the Site except the home page of the Site.
Privacy Policy
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully in accordance with the Data Protection Act 1998. We collect information about you for two reasons: to process your order and to provide you with best possible service. We reserve the right to inform you about our current offers and promotions unless requested otherwise. We do not disclose buyers information to third parties.
